Terms and Conditions of Sale

These Terms and Conditions of Sale (“Terms of Sale”) apply to online purchases of a paid period of access to the BlaBLaTeX service by an individual user. BlaBLaTeX is a service published and marketed by Balgoo. They supplement the Terms of Use.

Legal information relating to Balgoo is available in the Legal Notice. The processing of personal data is described in the Privacy Policy.

1. Purpose

These Terms of Sale define the commercial conditions applicable to the purchase of access to BlaBLaTeX: the selected offer, price, payment, access period, extension and the rules applicable to the sale. The rules governing the use and operation of the Service are set out in the Terms of Use.

2. Offers and free trial

BlaBLaTeX offers a free trial period allowing the User to evaluate the Service before making a purchase. Paid offers are purchased for a fixed period selected from those available on the website, up to the maximum duration displayed at the time of the order.

The applicable price and duration are those displayed before payment. Balgoo may change the prices of the Service for future orders, without affecting any period already purchased.

3. Order and payment

Before payment, the User selects the desired access period, reviews the corresponding total price and may consult these Terms of Sale. Validation of the payment confirms the order for the selected period.

The price is paid in a single payment. Payment is processed securely by a specialised payment service provider. Balgoo does not collect or store payment card details.

4. Access period and extension

Each purchase applies only to the period selected by the User. There is no automatic renewal and no recurring payment.

The User may extend their access by voluntarily making a new purchase for a period of their choice from the offers then available. The additional period is added to the current access period in accordance with the information displayed when placing the order.

5. Expiration

BlaBLaTeX sends email reminders as the expiration of the access period approaches. These reminders are for information purposes only and do not trigger any payment or automatic renewal.

If the User does not extend their access, access expires on the scheduled date and the account is deactivated. The User must export any projects they wish to keep before that date. Details concerning data and its deletion are set out in the Privacy Policy.

6. Right of withdrawal and refunds

Balgoo does not offer a commercial “satisfaction or money-back” guarantee for the BlaBLaTeX service. A change of mind, voluntarily ceasing to use the Service, or the Service no longer meeting the User’s needs does not, in itself, entitle the User to a refund.

Where the User acts as a consumer and benefits from the statutory right of withdrawal applicable to distance contracts, the User may exercise that right within the statutory period. As access is provided immediately after payment, the User requests that performance of the Service begin without waiting for the expiry of that period.

If the right of withdrawal is validly exercised after performance of the Service has begun, the amount corresponding to the Service already provided remains payable under the conditions provided by law. Except where a refund is required by law, a purchased access period is non-refundable.

7. Legal guarantee

Users acting as consumers benefit from the legal guarantee of conformity applicable to digital content and digital services under the conditions provided by the French Consumer Code. This guarantee applies to lack of conformity of the Service and is distinct from simple dissatisfaction or a change of mind.

8. Organisations

These Terms of Sale primarily concern individual subscriptions purchased directly online.

Companies, educational institutions, laboratories, public authorities and other organisations may benefit from specific arrangements, which may include prior contact, a quotation, purchase order, specific terms or a separate contract. The provisions agreed in such documents shall prevail for the matters they specifically govern.

9. Applicable law and dispute resolution

These Terms of Sale are governed by French law, subject to any mandatory provisions protecting consumers under the legislation applicable to their situation.

In the event of any difficulty or dispute relating to the Service or an order, the User is invited to contact Balgoo first in order to seek an amicable solution.

After contacting Balgoo and if no satisfactory solution is reached, the consumer may use the following consumer mediation service free of charge:

These Terms and Conditions of Sale are an English translation of the original French version. In the event of any discrepancy in interpretation, the French version shall prevail, subject to any mandatory consumer protection provisions applicable to the User.
